Terms and Conditions

Introduction

 please read all sections before agreeing to these terms and conditions. by agreeing to these terms and conditions, you are binding on any affiliate or organization.

1. Definitions and Interpretation

1.1. "Site" means Betrnk.com.

1.2. "Betrnk" means Betrnk.com.

1.3. "Company" means Well Treasure Technology N.V.

1.4. "Affiliate Program" means the partnership between the Site and the Partners. Partners shall promote Betrnk.com and continuously generate new players to the Site.

1.5. "Affiliate Partner" or "Partner" means any person who registers and participates in our Affiliate Program.

1.6. "Affiliate Partner Website" means affiliate.betrnk.com and refers to the platform (website/application/widget, etc.) maintained and operated by the Partner and which guides the Affiliate links and codes of the Site.

1.7. "Affiliate Link" means an Affiliate-only customer-directed link used by the Affiliate Partner when promoting the Affiliate. Players may use this link to complete registration and become a member of the Affiliate.

1.8. "Affiliate Code" means the code set for each Partner, which is set as a child member of the Partner even if this code is entered during the registration process.

1.9. "Player" means a person who has created a gaming account at Betrnk.com.

1.10. "Affiliate Account" means the account issued to an Affiliate upon registration as an Affiliate at affiliate.betrnk.com.

1.11. "Child Member" means a Player who has completed registration with Betrnk.com through the Affiliate's link or recommendation code.

1.12. "Site" means affiliate.betrnk.com.

1.13. "Commission" means the compensation given by the Site to the Affiliate Partner for fulfilling the conditions set forth in the Affiliate Plan.



2. Affiliate Partner Eligibility

2.1. Affiliate Partner represents and warrants that

a. Affiliate Partner has the right and authority to enter into a partnership agreement and to perform all its obligations

b. It has obtained and will maintain in effect all registrations, permissions, consents and licenses necessary to perform its obligations under the Affiliate Partner Agreement

c. Fully understand and agree to the terms of the Partner Agreement


3. our rights and obligations

3.1. We reserve the right to accept or reject new Partners at our discretion, and will review the submitted Partner information and notify Partners of the results via email.

We will keep a record of the total amount of commissions and make the total commissions and statistics available to Affiliate Partners on the (Affiliate Partner Website).

We shall pay commissions to Affiliate Partners in accordance with this Agreement.

We reserve the right to terminate, modify or close the Affiliate Program and to change any of the provisions of this Agreement at our discretion.

We will notify Affiliate Partners of any changes to the Affiliate Program or Affiliate account status by email.

3.6. We reserve the right to make final decisions, including the closure of a Partner's account, if the Partner fails to comply with any of the following

 a. Compliance with national and international regulations

 b.Comply with our policies

 c. Protection of the interests of the Company, players, child members or other third party organizations.

3.7. We shall use and process the following Partners' personal information for the purposes of high level security, compliance with anti-money laundering legal requirements and management of this business relationship, and in accordance with our Privacy Policy

 a. Name

 b. Date of birth

 c. Country of residence and address

 d. E-mail address and telephone number

 e. Account information


4. Affiliate Partner's Rights and Obligations

4.1. Affiliate Partner warrants and agrees to

 a. To market and promote the Site at its own expense in order to maximize to the greatest extent possible the benefit of the Site and its partners.

 b.Use affiliate links, affiliate codes, promotions, and marketing tools provided within the scope of the Affiliate Program

 c. The marketing activities of Partners will be appropriate and professional and in accordance with the provisions of these Terms and  Conditions.

 d. At all times comply with legislative and applicable laws related to data protection and privacy

 e. The Partner is responsible for the maintenance and development of all media (including websites, banner ads, links, e-newsletters, or otherwise) used to promote the Site and will update the advertising media from time to time as information on the Site is updated.

 f.The Partner shall be responsible for any liability incurred or any situation that may arise to the detriment of the Site in the event that the Partner's website contains content that is misleading to the Site's players or any person who has access to the Partner's website, including, but not limited to, players.

 g.To carry out marketing activities in a manner that is advantageous to the Website.

 h. Not to engage in marketing activities (including partner websites) that contain discriminatory, lewd, illegal, sexually explicit, pornographic, violent, or fraudulent content.

 i. Not target persons under the legal age of gambling

 j. Not target jurisdictions where gambling and gambling promotions are illegal.

 k.Except for the Site or the marketing tools posted on the Site, you will not use any other representation, trademark, or intellectual property of the Company or Betrnk's owner/operator without the Company's consent.

 l.Partner shall at all times maintain and protect the confidentiality of the login information provided by us.

 m. Partner is solely responsible for any unauthorized use of his/her login information due to a failure on Partner's part to properly protect his/her login information.

 n. Partner is solely responsible for all activities and actions under the Affiliate account user ID and password.

 o. Partner will immediately notify us of any suspected illegal and unauthorized use of its authentication.

4.2. We reserve the right to freeze the Affiliate account and deduct commissions from the Affiliate account if we determine that child members are being registered, referred or bet by fraudulent means or in violation of these Terms and Conditions.

 

5. Commissions

5.1. The Company shall pay commissions to Partners in accordance with these Terms and Conditions.<

5.2. The formula for calculating commissions is as follows

    Gross Revenue (BET Amount - Winnings) - Total Cost (Bonus/Deductible Costs + Correction Amount - Other Costs) x Commission Rate

5.3. Partners' commissions are due at the end of each month and calculated by the 5th of the following month.

5.4. After the calculation partners must submit withdrawal requests through the Site.

5.5. The requested amount will be deposited to the registered payment account sequentially from the 15th of each month.

5.6. If the payment date falls on a Japanese national holiday, the payment will be postponed to the next business day.

5.7. If an Affiliate Partner does not register their payment method by the commission payment date, payment will be postponed until registration is completed.

5.8.We reserve the right to change the payment date with prior notice.

5.9. We do not use negative carryover and negative commissions for the current month will be reset at the beginning of the following month.

5.10. The minimum commission payment is 10,000 yen. Withdrawal requests will not be accepted if the balance is less than 10,000 yen.

5.11. The following items will be deducted from your commission. In accordance with the principle of "mutual benefit," Betrnk reserves the right to make all final decisions in the event that one party receives unequal benefits due to fraudulent activity, including but not limited to the following

 a. Bonus costs

 b. Gaming platform fees

 c. Jackpot expenses

 d.Payment expenses[b].

5.12. Partners must refund in full any commissions received based on fraudulent or erroneous transactions.

5.13. We reserve the right to make all final decisions regarding any and all rights related to commissions, based on the official information on the Affiliate page of the Site.

 

6. Prohibitions

6.1. If any of the following prohibitions are found, we will forfeit all applicable commissions and freeze the Affiliate's account.

 a. Affiliate partner and child member have the same account (same IP address, same name, or any other account that we deem to fall under these categories)

 b. The affiliate partner himself/herself registers as a player through his/her own affiliate link (self-affiliation)

 c. A partner causes an existing player to re-register for a player account through the partner's own affiliate link and code (Duplicate Registration)

 d. Affiliate Partner becoming a child member of another Affiliate Partner

 e. Affiliate Partners working together to earn commissions.

 f. Working together with an Affiliate Partner and a Child Member or Player to earn commissions.

 g. Using your own affiliate account to increase commissions by registering yourself or a friend, employee or other third party as a player and making direct or indirect deposits into your player account for your personal use and that of others. All other acts that deceive the Company and the Site shall be considered fraudulent

 i. Any act of intentionally or accidentally divulging to a third party, whether a friend, player, or employee, any information that can be obtained after logging into the Site. The Partner shall be liable for any loss, injury or damage incurred as a result of such disclosure.


7. Liabilities and Limitation of Liability

7.1. We shall not be liable for

a. Any economic loss (including but not limited to profit, revenue, business, or contracts)

b. Loss of reputation, goodwill or goodwill of the Affiliate Partner or the Partner Website; 

c. Intentional, incidental, indirect or consequential loss

7.2. Partner agrees to indemnify and hold us and our Affiliates harmless from and against all losses, demands, claims, damages, costs (including, without limitation, consequential losses, loss of profits, reasonable legal costs, expenses and any such VAT) and liabilities incurred directly or indirectly by us arising from any breach or non-performance of any provision of this Agreement 7.2. The Company shall be obligated to indemnify the Company, its affiliates, affiliate partners, players of the Site, and child members upon demand for any and all liabilities incurred by the Company, directly or indirectly, including but not limited to claims, damages, loss of profits, reasonable legal costs, expenses, and any such VAT.

7.3. We shall not be liable for any loss or damage incurred by the Affiliate Partner, even if such loss or damage arises from our inability to operate the Affiliate Program as set forth in this Agreement.


8. confidential information

All information shall be treated as confidential and shall not be used, directly or indirectly, for any personal, commercial or other purpose without our prior express and written consent.

8.2. Affiliate Partners shall not use Confidential Information for any purpose other than the performance of their obligations under this Agreement.

8.3. Clause 8 shall survive termination of the partnership agreement.


9. Termination or Termination of Agreement

9.1. This Agreement may be terminated by either us or the Partner by sending a notice by e-mail. This Agreement shall automatically terminate if the Site ceases to provide services to the Player.

9.2. If either party is found to be in material breach of these Terms and Conditions, the other party has the right to terminate the partnership agreement immediately.

We reserve the right to terminate these Terms and Conditions and freeze an Affiliate's account upon notice by email if we have reasonable grounds to believe that the Partner is not actively promoting the Site,[d] for example In such case, we will forfeit all commissions in our possession.

a. In principle, if you do not introduce a reasonable number of child members to our site within 3 months of registering as a partner.

b.When we have a reasonable reason to believe that the Partner is not actively promoting the Site.

9.4. Upon termination of this Agreement, the Partner is obligated to return all confidential information and promotional tools to us. If, after the termination of this agreement, it is discovered that the aforementioned information has not been used or returned, the Partner shall return the proceeds to us and shall be liable for any damages or losses incurred.

9.5. Even after termination of this Agreement, the Partner shall not be released from any liability arising from any breach of these Terms and Conditions that occurred prior to termination.


10. Amendment of these Terms and Conditions and this Agreement

We reserve the right to amend, modify, change, delete or add any provision of these Terms and Conditions at any time without prior notice to Partner. Upon modification, Partners will be notified via e-mail address. Continued participation in the Affiliate Program after we have published any modifications or changes will constitute acceptance by Partner of the new Terms and Conditions.


11. Governing Law

These Terms and Conditions are governed by the laws of Curaçao. The User agrees that any dispute, complaint, breach, termination or invalidity arising from these Terms of Use shall be brought under the exclusive jurisdiction of Curaçao law.
